Tax Preparers Sue H&R Block over Unpaid, Mandatory Training Sessions

A lawsuit has recently been filed against H&R Block Inc. for its refusal to pay its tax professionals for mandatory training sessions between tax seasons pursuant to the Fair Labor Standards Act. Because the lawsuit was filed as a nationwide collective action, other similarly-situated H&R Block tax professionals may be eligible to join the lawsuit to recover their unpaid wages.

It is estimated that more than 100,000 tax professionals for H&R Block prepare tax returns for clients annually. A majority of these tax professionals, who prepare tax returns for clients during consecutive tax seasons, are believed to be subject to H&R Block’s pay policy at issue in the lawsuit. The Fair Labor Standards Act (FLSA) may permit these H&R Block tax professionals to recover unpaid wages for these 24 hours of mandatory training, plus liquidated damages, attorneys’ fees and litigation costs.
